Having sex with his former common-law partner after forcing her to go with him to a cottage has netted a Hubbards man a three-and-a-half-year prison term.

That's the sentence handed down in Supreme Court in Bridgewater Friday after the 35 year old was convicted of sexual assault and unlawful confinement following an earlier trial.

The man's name is being withheld to protect the identity of the woman he assaulted.

It happened back in November. The pair had split a few weeks earlier after living together for about a year. They were still seeing each other casually and the woman had picked the man up after work the previous day, spent the night at his apartment, then drove him to Halifax.

She was trying to drop him off at his place so she could return home when he took the keys from her car and went inside to get some things. When he returned, he insisted they travel to his parents' cottage in Mahone Bay.

They spent some time there drinking and smoking marijuana, but argued over the future custody of their unborn child. She wanted to leave, but he wouldn't let her. The couple later had intercourse. She eventually crawled out a bathroom window to escape and reported the incident to police.

He was arrested two days later and kept in jail because he was on a conditional sentence order at the time of the assault. That included terms to remain on house arrest when not working and to stay clear of alcohol and drugs.

In court last week, Crown attorney Paul Scovil said the fact that the pair had a previous relationship does not lessen the impact of the crimes.

"This has traumatized her," he said in asking the court to consider a prison sentence of three to four years.promotional towels Corporate branded towels created by Atomiconpromotional.

Dartmouth defence lawyer Alex Embree called that "way too high," saying the sexual assault happened in a domestic context amid what he called "psychological detention."

"This wasn't a preplanned take her out there and rape her," Mr. Embree said.
